Terms & Conditions

These Terms and Conditions (“Terms”, “Terms and Conditions”, or “Agreement”) constitute a legally binding agreement between Skyway Book1Trip LLP, operating under the brand name Book1Trip (“Book1Trip”, “Company”, “we”, “us”, or “our”), and any individual, business entity, organisation or other person accessing, registering on, purchasing from, or using the website https://book1trip.in/ (“Website”) or any product, platform, training, technology, support or other service made available by Book1Trip (“Services”).

By accessing the Website, submitting an enquiry, registering for a webinar, creating an account, making a payment, enrolling in a programme, activating a Travel Store, using a B2B booking portal or otherwise using any Service, you acknowledge that you have read, understood and agreed to be bound by these Terms, together with the applicable Privacy Policy and Refund & Cancellation Policy.

If you do not agree with these Terms, you should not access or use the Website or purchase any Service.

1. DEFINITIONS

For purposes of these Terms:

“Customer”, “User”, “you” or “your” means any person or entity accessing or using the Website or Services.

“Services” means any educational, technology, software, SaaS, travel-business, booking, consultancy, support, webinar, training, Travel Store, Travel Mastery, B2B portal, holiday-package or other service offered by Book1Trip.

“Third-Party Supplier” means any airline, hotel, DMC, GDS provider, bus operator, payment gateway, technology provider, travel supplier or other third party involved in delivering a Service.

“Account” means any user, member, agent, partner or customer account created for accessing a Book1Trip Service.

“Service Materials” means training videos, documents, presentations, templates, software, login credentials, guides, resources, designs, data, content and other materials supplied by Book1Trip.

2. ABOUT BOOK1TRIP

Book1Trip is a travel-business education, technology and support platform operated by Skyway Book1Trip LLP.

Depending upon the product selected, Book1Trip may provide:

Travel Business Training;

Travel Business Guidance;

Travel Store/SaaS solutions;

Travel Mastery programmes;

B2B travel booking technology;

Flight, hotel and bus booking solutions;

Holiday package and quotation support;

Back-office operational assistance;

Webinars and educational sessions;

Travel-business resources and tools; and

Other related products or services.

The exact features, access period, pricing, support and inclusions applicable to a customer shall be determined by the specific product or service purchased.

3. ELIGIBILITY

By using the Website or purchasing a Service, you represent and warrant that:

you have the legal capacity to enter into a binding agreement;

the information provided by you is accurate and complete;

you will use the Services only for lawful purposes; and

where you are acting on behalf of a business or organisation, you have the authority to bind that entity.

Book1Trip reserves the right to refuse, suspend or terminate access where information provided is materially false, misleading, fraudulent or otherwise in violation of these Terms or applicable law.

4. WEBSITE USE

You agree not to:

use the Website for unlawful purposes;

attempt to gain unauthorised access to any account or system;

interfere with Website security or functionality;

introduce malicious code or harmful software;

copy, reproduce or commercially exploit Website content without permission;

impersonate another person or entity;

submit false or misleading information;

misuse Book1Trip branding or intellectual property;

distribute unauthorised login credentials; or

use the Website in a manner that may damage Book1Trip or its users.

Book1Trip may restrict or terminate access where reasonably necessary to protect its systems, users, intellectual property or business operations.

5. WEBINAR REGISTRATION

Where Book1Trip charges a registration fee for a webinar, such fee is solely for registration and attendance at the applicable webinar/session, unless the applicable offer expressly states otherwise.

Payment of a webinar registration fee does not automatically include:

Travel Store access;

B2B portal access;

Travel Mastery;

complete business setup;

supplier or DMC contracts;

software development;

domain registration;

marketing services; or

any other separately priced product or service.

The webinar may explain business models, available products, required investment, support systems and other commercial information.

Customers should review the applicable offer and obtain clarification before purchasing any additional Service.

6. SERVICE-SPECIFIC TERMS

Each Service may have separate:

pricing;

validity;

activation requirements;

features;

usage restrictions;

support arrangements;

renewal terms;

cancellation conditions; and

other product-specific conditions.

Where product-specific terms are communicated before purchase, those terms shall form part of the applicable Service arrangement.

In the event of a conflict between these general Terms and a specific written Service agreement, the specific agreement shall prevail to the extent of the inconsistency.

7. PAYMENTS

All prices displayed by Book1Trip shall be subject to applicable taxes, fees and charges where stated.

The Customer is responsible for ensuring that payment information supplied during a transaction is accurate.

Payment may be processed through third-party payment gateways.

A transaction shall be considered successfully completed only upon confirmation of payment by the applicable payment processor and/or Book1Trip.

Book1Trip reserves the right to suspend service activation where payment is unsuccessful, reversed, disputed, charged back or otherwise not received.

8. DIGITAL AND SERVICE-BASED PRODUCTS

Certain Book1Trip Services are delivered digitally or through online systems, including:

LMS access;

online training;

webinars;

digital resources;

Travel Store access;

B2B portal access;

software/SaaS access;

account access;

online support; and

digital documentation.

Where access has been provided, activated or made available to the Customer, the Service shall be treated as delivered to the extent specified in the applicable Service terms, subject always to applicable law.

9. TRAVEL BUSINESS GUIDANCE

Travel Business Guidance is an educational and informational Service intended to help participants understand travel-business concepts, processes and available tools.

It does not constitute a guarantee of business success, employment, revenue, bookings or profits.

The Customer remains solely responsible for:

business decisions;

customer acquisition;

marketing;

pricing;

sales;

compliance;

supplier relationships;

bookings; and

day-to-day business operations.

10. TRAVEL STORE

Where a Customer purchases a Travel Store subscription, the applicable features shall depend upon the plan selected.

A Travel Store may include features such as:

branded online travel presence;

holiday packages;

itinerary tools;

quotation tools;

lead-management functionality;

package promotion tools; and

other features specified for the applicable plan.

Availability of third-party packages, destinations, hotels, suppliers and inventory is subject to supplier availability and applicable commercial arrangements.

Book1Trip does not guarantee that a Travel Store will generate any particular number of enquiries, customers, bookings or income.

11. B2B BOOKING PORTAL

B2B booking services may depend upon third-party airline, hotel, bus, GDS, API and supplier inventory.

Availability, fares, schedules, commissions, cancellation conditions and inventory may change at any time.

Book1Trip does not guarantee continuous availability of any particular supplier, airline, hotel, fare class, route or inventory.

The Customer shall verify booking details before completing or confirming a booking.

12. TRAVEL BOOKINGS AND THIRD-PARTY SUPPLIERS

Where Book1Trip facilitates or supports a travel booking, the applicable booking may be subject to the terms of the relevant airline, hotel, DMC, transport operator or other supplier.

Such supplier may independently determine:

availability;

pricing;

cancellation charges;

amendment charges;

refund conditions;

taxes;

baggage conditions;

check-in conditions; and

other booking conditions.

The Customer acknowledges that Book1Trip may act as a facilitator, technology provider, booking intermediary or support provider and may not control the policies or operational decisions of third-party suppliers.

13. NO GUARANTEE OF INCOME OR BUSINESS RESULTS

Book1Trip does not represent or warrant that any Customer will:

earn a particular amount;

recover the amount paid;

obtain a particular number of customers;

obtain a particular number of bookings;

achieve profitability;

establish a successful travel business; or

achieve any particular financial result.

Any examples, illustrations, projections, testimonials or business scenarios displayed on the Website are illustrative and shall not constitute a promise, guarantee or assurance of future results.

14. INTELLECTUAL PROPERTY

All intellectual property appearing on the Website or supplied as part of the Services, including:

trademarks;

logos;

designs;

text;

graphics;

videos;

training materials;

presentations;

software;

templates;

documents;

databases;

website layouts; and

other proprietary materials

shall remain the property of Book1Trip or the applicable rights holder.

No Customer receives ownership of such intellectual property merely by purchasing a Service.

Unless expressly authorised in writing, Customers shall not:

reproduce;

distribute;

resell;

sublicense;

publish;

modify;

commercially exploit; or

make available to third parties

any proprietary Book1Trip material.

15. CONFIDENTIALITY AND ACCOUNT SECURITY

Customers are responsible for maintaining the confidentiality of their login credentials.

Customers shall immediately notify Book1Trip if they become aware of unauthorised access.

Book1Trip shall not be responsible for losses arising from the Customer's failure to maintain reasonable security of account credentials.

16. SUPPORT

Depending on the Service purchased, Book1Trip may provide support through:

WhatsApp;

email;

chat;

voice notes;

Account Manager;

ticketing/support systems; and

telephone assistance in special or unresolved urgent matters.

Support availability, response times and channels may vary depending upon the Service.

Support does not constitute a guarantee that every technical, supplier or operational issue can be resolved immediately.

17. THIRD-PARTY LINKS AND SERVICES

The Website may contain links to third-party websites, payment gateways, booking systems, social-media platforms, suppliers or other services.

Book1Trip does not control third-party websites and shall not be responsible for their content, availability, privacy practices, security or terms.

Use of third-party services is subject to the relevant third party's terms and policies.

18. SUSPENSION AND TERMINATION

Book1Trip may suspend or terminate access where reasonably necessary due to:

violation of these Terms;

fraudulent or unlawful activity;

misuse of the platform;

unauthorised sharing of access;

non-payment;

security concerns;

chargeback or payment dispute;

misuse of intellectual property; or

other material breach of the applicable Service terms.

Termination shall not automatically extinguish rights or obligations accrued before termination.

19. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Book1Trip shall not be liable for indirect, incidental, consequential, special or loss-of-profit damages arising from use of the Website or Services.

Book1Trip shall not be responsible for losses caused by circumstances outside its reasonable control, including:

airline disruptions;

supplier failures;

internet or telecommunications outages;

payment-gateway failures;

cyber incidents;

government restrictions;

natural disasters;

strikes;

civil disturbances;

technical failures; or

other force majeure events.

Nothing in these Terms shall be interpreted as excluding or restricting any liability that cannot lawfully be excluded or restricted under applicable law.

20. INDEMNIFICATION

To the extent permitted by law, the Customer agrees to indemnify and hold harmless Book1Trip, its partners, officers, employees, representatives and service providers against claims, losses, liabilities, damages, costs and expenses arising from:

breach of these Terms;

misuse of the Services;

violation of applicable law;

unauthorised use of the Website;

infringement of third-party rights; or

fraudulent or misleading information supplied by the Customer.

21. FORCE MAJEURE

Book1Trip shall not be liable for failure or delay in performing obligations caused by circumstances beyond its reasonable control.

Such circumstances may include natural disasters, pandemics, government restrictions, war, civil disturbance, strikes, telecommunications failures, cyber incidents, supplier failures, airline disruptions and other events beyond reasonable control.

22. CHANGES TO SERVICES

Book1Trip reserves the right to modify, update, suspend or discontinue any feature or Service, provided that applicable legal obligations are respected.

Where a material change affects an already purchased Service, Book1Trip shall handle the matter in accordance with the applicable Service terms and applicable law.

Book1Trip shall maintain an appropriate grievance-redressal mechanism in accordance with applicable law. The applicable e-commerce framework requires relevant grievance information to be made accessible to users.

24. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of India.

Subject to any mandatory jurisdiction conferred by applicable consumer or other law, disputes arising from these Terms or the Services shall be subject to the jurisdiction of the competent courts having jurisdiction over the registered office of Skyway Book1Trip LLP.

Nothing in this clause shall be construed as restricting any statutory right or remedy available to a consumer under applicable law.

25. SEVERABILITY

If any provision of these Terms is held to be invalid, unlawful or unenforceable, such provision shall be modified or severed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

26. WAIVER

Failure by Book1Trip to enforce any provision of these Terms shall not constitute a waiver of its right to enforce that provision subsequently.

27. ENTIRE AGREEMENT

These Terms, together with the applicable Privacy Policy, Refund & Cancellation Policy and any specific written Service terms, constitute the agreement governing the Customer's use of the applicable Services.
